Brett Favre Announces He Won’t Invoke The Fifth Amendment
This week, Front Office Sports obtained case filings revealing that Brett Favre “does not intend to invoke the Fifth Amendment right against self-incrimination” in the civil case.
As a federal criminal defense lawyer points out, this is a pretty bold move, because it could give prosecutors more information than they currently have if he were to be hit with criminal charges in the future.
“Favre is playing a very dangerous game,” Matt Tympanick, a veteran federal criminal defense attorney, told Front Office Sports. “Though his statements made during these proceedings cannot come as direct evidence in a potential criminal case, they could come as impeachment evidence if Favre were to take the stand.”
“Favre testifying isn’t going to convince the U.S. Attorney’s Office to decline to file charges,” Tympanick said. “They potentially could get evidence via his testimony that they didn’t previously have.”
It’s a pretty insane move from Favre that nobody seemed to be expecting, and people had plenty to say about it on social media.
