Xavier Lucas seems to be caught in the corner in his battle with Wisconsin Badgers football as Big 10 said it will support the school with its attempt in blocking his transfer to Miami Hurricanes.
His lawyer is not giving up. In a long statement on X, Darren Heitner wrote 7 points countering the statement released by Wisconsin to address the Lucas situation.
The program said it is disappointed that Lucas is withdrawing from the school and under this unfortunate circumstances. It cited the agreement that they had with Xavier concerning financial compensation and Name, Image, and Likeness deals that remains enforceable and that Lucas should follow.
The school also accused Miami of tampering as it allegedly talked to the player even before the transfer portal.
“We have credible information indicating the impermissible contact between Xavier and University of Miami football program personnel prioer to Xavier’s request to enter the transfer portal. Direct interference with another institution’s committed player and contractual interests is prohibited by NCAA tampering rules and the law.”
Xavier Lucas’ lawyer 7 counter points
Heitner earlier this month accused Wisconsin of holding his client and preventing him from transferring to another school despite NCAA rules that football programs should grant an athlete’s request two days after announcing their intent to transfer school.
Lucas announced that he will enter transfer portal on December 20 but after eight days, he alleged that Wisconsin is preventing him from talking to other schools.
The lawyer called out the Wisconsin statement concerning NIL saying the way they handle the case is “subservient to NCAA rules.”
He also wrote that the football program only made accusations without supporting evidence.
There are many issues with Wisconsin’s statement:
1. It cites a “binding two-year NIL agreement,” but current NCAA rules do not currently allow institutions to provide compensation in exchange for an athlete’s NIL, and the agreement says it is subservient to NCAA rules.
