The Wisconsin Badgers will unfortunately have to move forward without a key defensive back as a proper decision has not been made in court.
Nyzier Fourqurean, the Badgers defensive back at the forefront of a battle against the NCAA over his final season of eligibility, must stop practicing with the team now. The Badgers filed an appeal on behalf of Fourqurean after receiving unfavorable news previously regarding his preliminary injunction. In doing so, the staff bought Fourqurean a 30-day window of practice time while his appeal was being processed.
However, with time now up, Fourqurean cannot practice with the program any longer as he is not considered to be an eligible player. The Wisconsin Badgers and the defensive back both fought for this final season due to the value that extra time would present to his growth on the field, but now may not have the chance to do so.
Wisconsin Badgers Must Move Forward Without Nyzier Fourqurean After No Decision is Made
Both Wisconsin and Fourqurean pushed for a speedy trial date and to have the case moved up the docket, however this was not the case. Two days ago, another glimpse of hope was revealed as the residing judge was set to look over the case before the start of the season. However, nothing was done and the judge opted to have the case continue as normal which was a situation the staff had been actively trying to avoid.
The result of not receiving a decision means the valuable appeal window that allowed Fourqurean to continue to practice with the Badgers has expired. Fourqurean will now be forced to practice elsewhere if he wants to stay in shape for a potential comeback in October following an official ruling.
Fourqurean can no longer practice with the #Badgers, per NCAA rules. His 30-day window while awaiting an appeal ruling is closed, so unless the NCAA suddenly changes its mind, Fourqurean’s eligibility will be decided by Judge Conley.

The current circumstances that Fourqurean is facing was something Wisconsin had tried to avoid for two main reasons, with the first being his ability to participate. Fourqurean cannot work with the Badgers since he is no longer an eligible player that is on the roster, which will almost certainly hurt his ability to comeback to the team in time should he receive a favorable decision.
The other issue for the Badgers and Fourqurean is also that both parties argued that the defensive back needs all of this time in order to progress further and reach his professional football dreams. Fourqurean will miss a minimum of the first eight games of the season and would be eligible to return with a favorable decision against Washington.
Fourqurean could return early if the judge makes a speedy decision or the NCAA has a sudden change of heart and decides to allow the defensive back to play.


As much strain as the situation has caused, for the Wisconsin Badgers business will continue to move as usual. The program is four days away from opening the college football season against Miami (OH) and had been preparing for such a situation to occur. Omilio Agard and D’Yoni Hill are expected to slide into the lineup for Fourqurean, with Agard taking on the majority of snaps in the new role.
For Fourqurean, unfortunately all that can be done now is wait and prepare for when he is able to return to the field and play.
