    Nyzier Fourqurean won his fight against the NCAA for now after getting clearance to continue playing for the program through a preliminary injunction issued by U.S. District Judge William Conley.

    The Badgers cornerback made headlines last week when he took the country’s leading college athletics organization for unfair rules that shortened his college eligibility which he said affects, too, his probable earning for his name, image, and likeness.

    Conley, according to the Associated Press, arrived to the ruling because Fourqurean is “likely to succeed” and that he “would suffer irreparable injury without injunctive relief.”

    “While defendant (the NCAA) frets that the court’s decision will open the floodgates of litigation by encouraging every student-athlete dissatisfied with defendant’s waiver denial to come to court, the injunction entered here does not enjoin defendant’s Five-Year Rule altogether,” Conley wrote.

    “Instead, it narrowly enjoins defendant from applying the Five-Year Rule against this plaintiff (Fourqurean) without demonstrating that his unique circumstances should not give rise to an exception.”

    The NCAA responded to the ruling by saying that it supports eligibility rules and it advocates for fair competition.

    “Altering the enforcement of foundational eligibility rules — approved and supported by membership leaders — that are designed to help ensure competition is safe and fair for current and future student-athletes makes a shifting environment even more unsettled.

    “The NCAA and its member schools are making changes to deliver more benefits to student-athletes, but the recent patchwork of state laws and court opinions continues to make clear that partnering with Congress is essential to provide stability for the future of all college athletes.”

    What is Nyzier Fourqurean’s biggest gain from this?

    Fourqurean filed the case last week as his way of pleading that he be allowed to play another year for the Wisconsin Badgers.

    He came to Wisconsin having played two years with Division II program Grand Valley State. He played his next two for the Badgers starting in 2023.

    Without the recent ruling, he would have become ineligible for the fall games. He argued that Division II years should have not being counted for his Division I stint.

    Another year of eligibility means more earnings for him. Part of his complaint last week was his aborted NIL earnings.

    He said during the Tuesday hearing that he made around $5,000 from NIL in 2023 and $45,000 the next year. He forecasts that he could around six digits if he gets to play again this year.

    In another testimony, a sports marketing consultant the player’s camp talked to said he could earn around $250,000 to $500,000.

    Had the ruling went the opposite way, Fourqurean would have been forced to declare for the 2025 NFL Draft where is expected to be picked in the fourth round. The earnings will not be as much.
